Terms of Service

These Terms of Service ("Terms") govern your access to and use of gigemployee.in (the "Platform"). By creating an account, posting a project, placing a bid, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Who We Are

GigEmployee ("we", "us", "the Platform") is an online platform operated from India that connects Employers who want work done ("Clients") with Freelancers who offer their services ("Freelancers"). Any account may act as both a Client and a Freelancer — there is no fixed account type.

2. What We Are (and Aren't)

GigEmployee is a connection and productivity platform, not a payment processor, escrow agent, or party to any work agreement. We give both sides the tools to find each other, agree terms, and track work (project listings, bidding, contact exchange after a bid is accepted, messaging, a milestone-planning tool, task tracking, and verification review). GigEmployee never collects, holds, or transfers payment for any project work. Employers and Freelancers negotiate their own price and payment schedule and pay each other directly, by whatever method they agree (bank transfer, UPI, cash, etc.) — entirely outside the Platform. We do not employ Freelancers, are not a staffing agency, and do not guarantee the quality, legality, or timeliness of any work delivered, or a Client's or Freelancer's ability or willingness to pay or be paid as agreed.

3. Account Registration & Verification

Accounts are authenticated via a one-time password (OTP) sent to your registered email — we do not store passwords. You're responsible for keeping access to your registered email secure and for all activity under your account. A "Verified" badge is granted only after our team manually reviews a submitted government ID proof together with a portfolio, LinkedIn, or GitHub link; it indicates our team completed this review, not a guarantee of a Freelancer's skill, work quality, or trustworthiness.

4. Free First Gig & Subscription

Every account's first gig — the first time you, as a Client, accept a bid, or the first time you, as a Freelancer, are hired on an accepted bid — is free of charge. After that free gig has been used, your account needs an active paid subscription (currently ₹49.00/month, shown at checkout and adjustable by us from time to time) to accept a bid or be hired on one again. The subscription fee is the only payment GigEmployee ever collects from you; it pays for continued access to the Platform's matching, messaging, and project-tracking tools, not for any project work itself. We may change the subscription price prospectively; changes do not apply to a subscription period you've already paid for.

5. Bidding, Hiring & Contact Exchange

Freelancers may place one active bid per project at a time, and may edit or withdraw an active bid at any point before it is accepted. Once a Client accepts a bid, all other bids on that project are automatically closed and both parties' contact details (email and phone number, if provided) are unlocked so you can coordinate and pay each other directly. Either side may cancel a hire and reopen the project for bidding before any milestone has been marked paid; once money has changed hands between you, a hire can no longer simply be reversed and any disagreement should be raised as a dispute (see Section 7).

6. Milestones

The Platform provides an optional "Milestones" tool so both parties can record agreed payment checkpoints (title, amount, due date) and mark each one as paid once settled directly between them. This is a shared record for your own reference and for our team to review if a dispute is later reported — it is not a payment instruction, escrow account, or guarantee of any kind, and marking a milestone "paid" is a self-reported statement by whichever user does so, not something GigEmployee verifies.

7. Deliverables

Freelancers may optionally upload final work files through the Platform's "Deliverables" tool. A deliverable stays locked from the Client's download until the Freelancer who uploaded it — and only that Freelancer — confirms they have received payment for it directly. This is a self-reported confirmation by the Freelancer, not something GigEmployee independently verifies. Because the Platform stores the uploaded file itself (unlike project payment, which we never touch), we may, solely in connection with reviewing a reported dispute, force-unlock a deliverable if we find the Freelancer has been paid but is unreasonably withholding it. Deliverables shared this way are not a substitute for the parties' own backups of their work, and GigEmployee is not responsible for loss of an uploaded file.

8. Disputes & Account Standing

If a Client or Freelancer believes the other party has not delivered, not paid, or otherwise breached what was agreed, they may report a dispute from the project page. Our team will review the evidence available on the Platform — chat messages, milestones, tasks, and timeline — for that project. Because GigEmployee never holds project funds, a dispute review does not result in us releasing or refunding any payment. Instead, if we find a policy violation, we may issue the offending account a formal warning or ban it from the Platform (blocking future logins, bidding, hiring, and posting). Our decision is based solely on the information available to us and is made at our reasonable discretion; it does not determine legal liability between the parties, who remain free to pursue their own remedies (including through a consumer forum, mediation, or court) for money owed to them.

9. Prohibited Conduct

Users may not: attempt to bypass the Platform's contact-unlock rule by sharing personal contact details (phone numbers, personal email addresses, UPI IDs) in chat before a bid is accepted — our systems automatically detect and mask such details before a bid is accepted, and repeated attempts may result in account suspension; post fraudulent, illegal, or infringing project listings; upload malicious files or files that infringe another party's rights; harass or abuse other users; submit false verification documents or false milestone records; misuse the free-gig credit (e.g. via duplicate accounts); or attempt to manipulate ratings, reviews, or bids (including placing duplicate or shill bids).

10. Content & File Uploads

You retain ownership of files, messages, and work you upload, but grant the other party to a project a license to use deliverables you send them for the purpose of that project. You are solely responsible for the legality and safety of files you upload (chat attachments, task files, portfolio images, verification documents); we scan uploads for file type and size but do not review file content before it becomes available to the other party on a project.

11. Limitation of Liability

GigEmployee is not liable for the quality of work delivered, for any payment arranged and made directly between a Client and a Freelancer, for indirect or consequential damages, or for disputes over work or payment arranged outside the Platform. Our total liability to any user in connection with a given account is limited to the subscription fees we collected from that user in the preceding three months.

12. Termination

We may suspend or ban an account that violates these Terms, attempts to circumvent the contact-unlock rule or the free-gig/subscription system, submits fraudulent verification documents or milestone records, or abuses other users. Since we hold no project funds, termination has no effect on payment obligations between Clients and Freelancers, which remain the parties' own responsibility.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts at Pune, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or use of the Platform, without prejudice to any mandatory consumer-forum rights you may have under Indian law.

14. Grievance Officer & Contact

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, complaints regarding content or conduct on the Platform, or questions about these Terms, may be directed to our Grievance Officer at support@gigemployee.in. We aim to acknowledge complaints within 24 hours and resolve them within 15 days.
